Purchase order terms and conditions
The scope and validity of the terms and conditions
1.1 The terms and conditions apply to the legal relationship arising between a person (hereinafter: Customer) and the owner of the shopping portal kinkekaart.spaestonia.ee (hereinafter: Online shop), Estonia Spa Hotels AS (hereinafter: SPA), upon the purchase of products in the SPA’s online shop.
1.2. In addition to these terms and conditions, the legal relationship arising upon the purchase of products in the SPA’s Online shop is governed by the legislation of the Republic of Estonia.
Price, change of service, validity and extension of validity
2.1.1 All prices of the services and products sold in the Online shop are given in euros.
2.1.2 The value of a service-based gift card purchased from the Online shop may differ from the counter price valid at the time of booking/consumption/ purchase of the corresponding service. The price difference will not be compensated if the price of the booked service is lower than the value of the gift card.
2.2. Change of service
2.2.1 A gift card purchased from the Online shop will not be exchanged for cash or for a new gift card.
2.2.2 The Customer has the right to exchange any service indicated on the SPA gift card for SPA accommodation. SPA accommodation includes breakfast and a visit to the spa centre at ESTONIA Resort Hotel & Spa or ESTONIA Medical Spa & Hotel, taking into account that if the price of SPA accommodation is less than the value of the service of the gift card, then the price difference will not be compensated. If the amount of SPA accommodation exceeds the value of the gift card, the owner of the gift card must pay the subtotal additionally.
2.2.3 A service-based gift card can be exchanged for SPA accommodation only through the sales department of SPA (open Mon-Fri 8:00-16:30, except Estonian national holidays, when the sales department is closed):
* Please send your service exchange request for hotel accommodation in writing to: firstname.lastname@example.org.
* Please indicate the number of the gift card in the request letter. When exchanging a service-based gift card for SPA accommodation, you must MAKE A BOOKING IMMEDIATELY at either ESTONIA Resort Hotel & Spa or ESTONIA Medical Spa & Hotel. For booking please add the name of the corresponding hotel and the date(s) of the visit, the room type and the number of guests (including children with their age) in the application.
*The sales department responds to the customer in writing to the same e-mail address from which the customer’s request came.
* If the service of the gift card has already been booked in advance, the service cannot be exchanged for accommodation.
2.2.1 The gift card purchased from the Online shop will be valid for 12 months, unless the validity period is indicated differently for the respective service in the Online shop.
2.4 Extension of validity
2.4.1 The validity of the gift card can be extended once for 6 months, the change fee is €25 per gift card.
2.4.2 Expired gift cards will not be renewed.
2.4.3 Lost or damaged gift cards will not be replaced.
Placing an order
3.1 Orders can be placed on the Online shop website kinkekaart.spaestonia.ee as a guest.
3.2 The Customer selects the gift voucher(s) in the Online shop and adds the gift vouchers to the basket.
3.3 The Customer fills out the data in the Checkout view and enters his/her e-mail address to receive the gift voucher with a unique number.
3.4 The Customer confirms the basket and pays for the gift card(s) in the payment portals made available by the seller. Before paying the invoice, the Customer checks that the data provided in the invoice corresponds to what the Customer has ordered.
3.5 After paying for the gift card(s), the Customer should click on the link “Return to merchant”.
3.6 The seller e-mails a confirmation and invoice to the Customer stating receipt of the order and payment.
4.1 The Customer must pay the full price of the selected service/product. By paying, the Customer declares to be familiar with and accept all the terms and conditions and rules made available by the service provider through the online shop.
4.2 Payment of the amount due is made by bank transfer or using Master card/ Visa debit or credit card payments.
Bank transfers can be made from the following banks: Swedbank, SEB, Citadele, Luminor (EE, LV, LT), Coop and LHV (EE) and Šiaulių bankas (LT) and Medicinos bankas (LT).
4.3 After making a bank transfer or card payment, the Customer should click on “Return to merchant” to register the payment immediately.
4.4 The payment services are provided by Swedbank AS. Payments are made outside the Online shop in a secure environment – for bank links, in a secure portal of the respective bank, and for credit card payments, in Swedbank’s secure portal. The seller has no access to the Customer’s bank and credit card information. The contract will enter into force after full receipt of the amount due on the seller’s bank account.
4.5 The owner of the Online shop is the controller of personal data, who will transfer the personal data required for processing the payments to the processor, Swedbank AS.
5.1 When the payment is completed, the gift voucher the Customer purchased will be sent to the Customer as a downloadable gift voucher to the e-mail address previously provided by the Customer.
Cancellation of the order, and refund
6.1 After buying a gift voucher from the Online shop, the Customer will have the right to withdraw from the sales contract within 14 days of the date of receipt of the gift voucher to his/her e-mail address. Please send the request for cancellation of the sales transaction together with the corresponding gift card voucher to the e-mail: email@example.com.
6.2 It is not possible to withdraw from the transaction if the unique code on the gift voucher has already been used.
Confidentiality and the processing of personal data
7.2. The owner of the Online shop is the controller of the personal data, who will transfer the personal data required for processing the payments to the processor, Swedbank AS.
Liability and force majeure
8.1 The SPA and the Customer are liable to each other for any damages caused to the other party by violation of these terms and conditions, in the cases and to the extent provided for in the legislation of the Republic of Estonia.
8.2 The SPA will not be held liable for any damages caused to the Customer or any delays in the delivery of the products if the damages or the delay in the delivery are caused by circumstances which the SPA could not have affected or foreseen (force majeure).
9.1. Any disputes arising with regard to the ordering and purchase of products from the SPA’s Online shop will be resolved through negotiations. Upon failure to reach agreement, the Customer will have the right to turn to the Consumer Protection Board or to the court in order to protect his/her rights. In case of disputes and in any issues not governed by these terms and conditions, the legislation in force in the Republic of Estonia will apply
